By using Koda, you agree to these Terms of Service. If you disagree, don't use our service.

You must be 18 years or older to use Koda. By creating an account, you confirm you meet this requirement.

3. ACCOUNT RESPONSIBILITIES

• You're responsible for your account security
• Don't share accounts or passwords
• Notify us immediately of unauthorized access
• You're liable for all activity under your account

4. ACCEPTABLE USE

You agree NOT to:

• Use Koda for illegal activities
• Harass, abuse, or harm others
• Attempt to manipulate or exploit the AI
• Reverse engineer our systems
• Use Koda for commercial purposes without permission
• Create multiple accounts to abuse free tiers

Koda utilizes advanced AI safety systems designed to:

• Maintain appropriate conversational boundaries
• Decline harmful or inappropriate requests
• Focus on emotional support and companionship
• Protect user wellbeing

While our AI technology includes robust safety measures, users must not attempt to:

• Circumvent safety features
• Engage in romantic or sexual interactions
• Use Koda for illegal purposes
• Manipulate responses for harmful content

Our AI is designed to redirect inappropriate requests to supportive alternatives.

7. SUBSCRIPTION AND PAYMENT

• Free Tier: 50 messages daily with limited features
• Paid Tiers: Billed monthly or annually as selected
• Refunds: Cancel anytime, access continues until period ends. Refund requests within 48 hours of purchase: Full refund. No refunds for used monthly periods after 48 hours. Contact hello@hikoda.ai for refund requests
• Cancellation: Cancel anytime; access continues until period ends
• Price Changes: 30 days notice for existing subscribers

8. INTELLECTUAL PROPERTY

• You own your conversation content
• We own the Koda service, AI, and technology
• Our proprietary AI technology may utilize various providers and models which we may change without notice to improve service quality
• You grant us license to use your conversations to:
  • Provide the service
  • Improve our AI models
  • Create anonymized insights

9. PRIVACY

Your use is governed by our Privacy Policy. By using Koda, you consent to our data practices.

You agree to indemnify and hold harmless Hikoda LLC from any claims arising from your use of Koda or violation of these terms.

We may terminate or suspend your account immediately for Terms violations. Upon termination, your right to use Koda ceases.

14. GOVERNING LAW

These Terms are governed by New Jersey law. Disputes shall be resolved in New Jersey courts.

15. CHANGES TO TERMS

We may modify these terms. Continued use after changes constitutes acceptance.

16. SERVICE MODIFICATIONS

We reserve the right to modify, suspend, or discontinue any aspect of Koda, including:

• AI behavior and responses
• Features and functionality
• Safety measures and content filtering

With reasonable notice when feasible
